Information document for exercising the right of withdrawal provided for in Article L.112-10 of the French Insurance Code.
You have acquired or are about to acquire a bicycle and wish to insure against the risks of theft and damage. The "Bikelp SLP Bicycle Insurance" contract addresses this need and provides suitable coverage.
You are advised to verify that you do not already benefit from coverage covering any of the risks insured under the new policy. If you do, you have the right to withdraw from this policy within fourteen (calendar) days from its conclusion, without fee or penalty, provided that all the following conditions are satisfied:
In such circumstances, you may exercise your right of withdrawal by letter or any other durable medium addressed to the insurer of the new policy, accompanied by documentation proving that you already hold coverage for one of the risks insured under the new policy. The insurer must reimburse the premium paid within thirty days from your withdrawal.
If you wish to cancel your contract but do not meet all of the above conditions, please review the cancellation terms set out in your contract.
Certain terms have a specific meaning when appearing in bold type in this document and in Your Specific Terms. These terms are defined below.
These General Terms and Conditions must be read alongside Your Specific Terms, which, together with the representations You provided to Us, form the legal basis of the insurance contract.
Terms highlighted in bold have dedicated meanings. The exact definition of each bold term is set out in the Definitions section of these General Terms and Conditions.
If any detail contained in these documents is inaccurate or requires modification—for example, if You have moved—please inform Us immediately.
In the event of any discrepancy between these General Terms and Conditions and Your Specific Terms, the provisions of Your Specific Terms shall prevail.
Please review Your Specific Terms carefully, as Your policy might not include all coverage modules outlined in clause 15 of this document.
We reserve the right to amend the provisions of these General Terms and Conditions or Your Specific Terms, including the Capped Monthly Premium, by providing You with at least one month's prior written notice.
The policy renews automatically each calendar month, unless We cancel the policy or You cancel it beforehand—see clauses 6 and 7.
This policy is governed by and construed in accordance with French law.
Your coverage begins when We issue Your Specific Terms, starting on the effective inception date stated therein.
4.1. Your Premium consists of two components:
(a) Your share of the Community's claims costs
Each month, Bikelp SLP calculates Your proportionate contribution to the claims incurred across the Community during the preceding month. This share reflects the actual net claims paid on behalf of Community members and will vary month to month.
(b) Bikelp SLP management fee
Each month, You also pay a flat management fee to Bikelp SLP. This fee is charged under the provisions of this policy to remunerate Bikelp SLP for its duties as agent of the Insurer. Acting as agent, Bikelp SLP manages underwriting placement with the Insurer, administers policy adjustments, handles and settles claims, and maintains the Bikelp SLP Platform. The amount of this fee is detailed in Your Specific Terms.
4.2 Total Premium
The total monthly sum payable corresponds to Your share of Community claims, the Bikelp SLP management fee, and the statutory insurance premium tax. Your monthly Premium will never exceed the Capped Monthly Premium specified in Your Specific Terms, regardless of total claims volume incurred by the Community.
You will receive a monthly statement outlining the calculation breakdown of Your Premium for the billing period.
4.3 Premium Collection
On the third business day of every month, Bikelp SLP will collect the Premium due for the prior month. The charged amount reflects strictly the calendar days You were insured. Your monthly Premium will never exceed Your Capped Monthly Premium.
If direct collection fails, We will notify You of the default. You will be given 14 calendar days to settle the outstanding amount, failing which We may suspend coverage or terminate the policy retroactively to the final day of coverage for which payment was successfully collected.
If We have settled a claim arising during a period for which Premium remains unpaid, We reserve the right to recover the full value of that settlement from You.
We reserve the right to report payment defaults to relevant credit reference agencies.
You may cancel Your policy within 14 calendar days following policy inception and delivery of Your contractual documentation. If You have lodged a claim during this 14-day window, You will remain liable for the pro-rata Premium covering the days during which coverage was active.
To cancel Your insurance, please refer to clause 6.
You may cancel Your insurance by contacting Bikelp SLP through the Bikelp SLP Platform or by email.
When You take out a new policy or adjust Your Plan via the Bikelp SLP Platform, a mandatory 30-day lock-in period may apply, during which cancellation is unavailable—You will be informed of any such lock-in period before it takes effect on the platform.
Following this initial period, You may cancel Your policy at any time via the Bikelp SLP Platform or by email. You will remain responsible for paying the pro-rata Premium for the days during which coverage was in force during the month of termination. Your final statement will be generated at the end of that billing month.
You benefit from a 14-day statutory cooling-off period starting from the effective date of the policy and delivery of Your documentation. If You choose to renounce coverage during this period, You may do so free of charge, unless a claim has been filed, in which case the Premium for that period remains due.
Bikelp SLP may revise the terms of Your policy subject to one month's advance notice. Should You decline to renew under the amended terms, You may cancel the policy by notifying Us.
If You cease to be the legal owner of the Insured Equipment, You may terminate the policy at any time by notifying Us.
You remain liable for all accrued Premium covering the period during which You were insured.
We reserve the right to terminate Your policy:
Where fraudulent misrepresentation or dishonest conduct is established, We reserve the right to enforce any or all of the following measures:
Please review the full Bikelp SLP Anti-Fraud Policy for further information.
We comply strictly with international sanctions frameworks. We shall not be deemed to provide cover, nor be liable to pay any claim or provide any benefit hereunder to the extent that such cover, payment, or service would expose Us to any sanction, prohibition, or restriction under United Nations resolutions or trade and economic sanctions laws or regulations of the European Union, Switzerland, the United Kingdom, or the United States of America.
If You are added to an official sanctions register, Your policy will be cancelled immediately.
When reporting a claim, You must:
Failure to adhere to these requirements may result in the reduction or total repudiation of Your claim settlement.
We will arrange for the repair or new-for-old replacement of the Insured Equipment or, at Our option, issue a cash settlement directly to You or directly to an authorised trade supplier.
The maximum indemnity payable shall not exceed the insured value specified in Your policy schedule.
You must settle any applicable Deductible prior to Us concluding a claim through direct supplier disbursement.
Where We settle a claim in cash, the maximum payout corresponds to the cost to replace the item of Insured Equipment like-for-like with a new item at the date of loss, subject to the policy limits in Your Specific Terms. Where cash settlements are approved, payment will be transferred within 5 business days.
Following claim settlement, it remains Your responsibility to amend or cancel Your policy schedule accordingly.
11.1. Under-insurance
If the declared sum insured on any item of Insured Equipment is lower than its true new-for-old replacement cost at the date of claim, We will apply the principle of average, reducing the payout in proportion to the difference between the insured amount and the full replacement value.
11.2. Salvage / Subrogation and Recovery
Upon payment of a total loss indemnity, We reserve the legal right of ownership over the salvaged or recovered Insured Equipment, or to exercise subrogation rights against responsible third parties.
